ARTICLE 1 – SCOPE

These General Conditions of Sale apply, without restriction or reservation, to any transaction between MONACO PRESTIGE LIMOUSINES and consumers and non-professional customers (‘The Customers or the Customer’) in connection with the reservation of vehicles with driver via the platform / website www.monaco-prestige-limousines.com also accessible via the address www.mpl.mc.

The main characteristics of the Services are presented on the platform / website www.monaco-prestige-limousines.com .

The Customer is required to read it before placing an order. The choice and purchase of a Service is the sole responsibility of the Customer.

These conditions apply to the exclusion of all other conditions, and in particular those applicable to other Services marketing channels.

They may be supplemented by special conditions, set out on the website, before any transaction with the Customer.

These General Conditions of Sale are accessible at any time on the website and will prevail, if necessary, over any other version or any other contradictory document.

Unless proven otherwise, the data recorded in the service provider’s computer system constitutes proof of all transactions concluded with the Client.

The Customer declares to have read these General Conditions of Sale and to have accepted them by ticking the box provided for this purpose before the implementation of the online ordering procedure.

The validation of the Services order by the Customer implies acceptance without restriction or reservation of these General Conditions of Sale.

The Customer acknowledges having the capacity required to contract and acquire the Services offered on the platform / website www.monaco-prestige-limousines.com .

These General Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer’s purchase is that in force on the website on the date of placing the order.

The Services presented on the platform / website www.monaco-prestige-limousines.com are offered for sale for the following territories: Principality of Monaco, France and more broadly, Europe.

ARTICLE 2 – ORDERS

The Customer selects on the site the services he wishes to order, according to the following methods:

The contractual information is presented in French or in English and is subject to confirmation at the latest when the order is validated by the Customer.

The registration of an order on the Service Provider’s site is made when the Customer accepts these General Conditions of Sale by ticking the box provided for this purpose and validates his order.

The Customer has the possibility to check the details of his order, its total price and to correct any errors before confirming his acceptance.

This validation implies acceptance of all of these General Terms and Conditions of Sale and constitute proof of the sales contract.

It is therefore up to the Customer to verify the accuracy of the order and to immediately report any errors.

The sale of Services will only be considered final after the Service Provider has sent the Customer confirmation of acceptance of the order, by e-mail and after receipt by the latter of the full price.

Any order placed on the platform / website www.monaco-prestige-limousines.com constitutes the formation of a contract concluded at a distance between the Customer and the Service Provider.

MONACO PRESTIGE LIMOUSINES reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

When an order is validated more than 3 days before the date of the service, the Customer benefits from the right of withdrawal provided for by Sovereign Ordinance No. 6.702 of December 7, 2017. The service ordered will be canceled free of charge.

When an order is validated less than 3 days before the date of the service, the Customer expressly waives his right of withdrawal.

ARTICLE 3 – PRICES

The Services offered by MONACO PRESTIGE LIMOUSINES are provided at the rates in force on the platform / website www.monaco-prestige-limousines.com .

These rates are firm and non-revisable during their period of validity, as indicated on the platform / website www.monaco-prestige-limousines.com .

An invoice is drawn up by the Service Provider and given to the Customer when the Services ordered are provided.

 

ARTICLE 4 – PAYMENT CONDITIONS

The price is payable in cash, in full on the day the order is placed by the Customer, according to the terms specified in the ” Orders ” article above, by means of secure payment by bank card: Bank Card, Visa, MasterCard , American Express, other bank cards.
Payment by bank card is irrevocable, except in the case of fraudulent use of the card. In this case, the Customer may request the cancellation of the payment and the return of the corresponding sums.

Payment data is exchanged in encrypted mode using the HTTPS/SSL protocol.

 

ARTICLE 5 – INTELLECTUAL PROPERTY

The content of the platform / website www.monaco-prestige-limousines.com is the property of MONACO PRESTIGE LIMOUSINES .

It is protected by Monegasque and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.

 

ARTICLE 6 – FORCE MAJEURE

The Parties cannot be held liable if the non-execution or the delay in the execution of any of their obligations, as described herein, results from a case of force majeure.

 

ARTICLE 7 – APPLICABLE LAW – LANGUAGE

These General Terms and Conditions of Sale and the resulting transactions are governed by Monegasque law.

They are written in French. In the event that they are translated into one or more languages, only the French text shall prevail in the event of a dispute.

 

ARTICLE 8 – DISPUTES

All disputes to which the purchase and sale transactions concluded in application of these general conditions of sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not have be resolved between the seller and the customer will be submitted to the competent courts of the Monegasque civil order under the conditions of common law.

 

ARTICLE 9 – PRE-CONTRACTUAL INFORMATION – CUSTOMER ACCEPTANCE

The fact for a natural (or legal) person to order on the Platform / the website www.monaco-prestige-limousines.com implies full and complete acceptance and acceptance of these General Conditions of Sale and obligation to pay for the Services ordered, which is expressly recognized by the Customer.
